Welcome to Flammingo. These Terms of Service ("Terms") govern your use of the Flammingo app operated by Aduasth Technologies Pvt. Ltd. ("Company", "we", "us", or "our").

1. Acceptance of Terms

​

By downloading, installing, or using Flammingo, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. User Accounts

​

To use most features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.

• Maintain the security of your password and accept all risks of unauthorized access to your account.

• Notify us immediately if you discover or suspect any security breaches related to the Service.

 

3. Subscriptions & Payments

​

• Pricing: Flammingo offers both free and paid ("Integration Tier") features. Paid features are billed on a subscription basis.

• Billing: Payments will be charged to your iTunes Account or Google Play Account at confirmation of purchase.

• Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

• Cancellation: You may manage your subscriptions and turn off auto-renewal by going to your Account Settings after purchase.

 

4. User Conduct

You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, harassment, defamatory, vulgar, obscene, or invasive of another's privacy.

• Impersonate any person or entity or falsely state your affiliation with a person or entity.

• Attempt to reverse engineer, decompile, or disassemble the AI models or software.

• Use the Service for any commercial purpose without our express written consent.

• "Jailbreak" or attempt to bypass the safety protocols and ethical guidelines of the AI.

 

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Aduasth Technologies Pvt. Ltd. and its licensors. The Flammingo name, logo, and "The Conversational Cognition Agent" tagline are trademarks of the Company.

 

6. Termination

​

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

 

7. Limitation of Liability

In no event shall Aduasth Technologies Pvt. Ltd., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

 

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

 

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Hyderabad.

 

10. Changes

​

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
